Terms and Conditions

By purchasing from our site, you are agreeing to the terms and conditions.

 These terms and conditions ('the Terms') govern the users ("you" or "your") use of the website www.jnicoleskincare.com (the "Website"). Any reference to "we"/"us"/"our" in the Terms is a reference to J.Nicole Skincare. Please read them carefully as they affect your rights and liabilities under law. If you do not agree to these Terms, please do not access or use the Website. If you have any questions regarding these Terms then please contact us.

1. AGREEMENT

By using the Website, which includes purchasing any of the products, you agree to be bound by these Terms.

2. CHANGES TO THE TERMS AND CONDITIONS

We reserve the right to:

update these Terms and any changes will be notified to you via a notification on the website or via email. Major changes will be notified via email. It is your responsibility to check the Terms for such changes. If you do not wish to accept the new Terms you should not continue to use the Website. If you continue to use the Website after the date on which the announcement of the changes is made, you agree to be bound by the new Terms. If you do not agree with the terms, you must stop using the Website immediately.

You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the delivery address which you specified.

For international shipments, you may need to pay customs fees before receiving your products. J.Nicole Skincare ® is not responsible for paying the customs fees. It is the customer's responsibility to pay the customs fees.

4. REGISTRATION

You warrant that:

the personal information which you are required to provide when you register is true, accurate, current and complete in all respects; and you are not impersonating any other person or entity.

The products purchased on this site are not for resale and they are for private and domestic use only. You will notify us immediately of any changes to the personal information by e-mailing our customer service representatives at:

 5. PROTECTING YOUR SECURITY

You are responsible for the protection of your username and password. We are not responsible for losses suffered when someone else uses your username and password unless this is due to our negligence. You must notify us immediately at  nicole@jnicoleskincare.com if you believe your account is being used without your consent.

6. COMPLIANCE

The Website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes, and regulations regarding the Website and its use. You agree that in using the Website you will not: (i) upload or transmit through the Website any computer viruses or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer; and any material which is defamatory, offensive or of an obscene character; (ii) use the Website which would result in damage to the name J.Nicole Skincare; (iii) use the Website for criminal, fraudulent or illegal activity or in any manner which would cause harm or distress to any third party, or access or use the accounts of other users.

7. INDEMNITY

You agree to fully indemnify, defend and hold us, and our directors, employees, and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms by you, or any other liabilities arising out of your use of this Website or any other person accessing the Website using your personal information.

 8. ORDERS

All orders are subject to acceptance by us and subject to availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.

Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The contract between you and us is formed when we send you an email dispatch confirmation. The conclusion of a contract between you and us will take place when we (i) debit your credit, debit card or Amazon Pay or PayPal account, whichever is the later. We will file any orders that are accepted by us.

Payments can be made via PayPal, Amazon Pay or via debit or credit card. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order. You confirm that the credit/debit card/PayPal/AmazonPay account used is yours. If fraudulent activity is suspected, we have the right to cancel your order. In some cases, if fraudulent activity is suspected, you may be contacted via e-mail from nicole@jnicoleskincare.com to confirm if the order is yours. You must reply to this e-mail within 10 working days. Your order will not be processed until you have confirmed that the activity on your account is not fraudulent.

The products sold on the Website are not for resale or distribution. We reserve the right to cancel orders and/or suspend accounts where we believe products are being ordered in breach of this provision.

We will dispatch the product to you within 2 working days of us accepting payment from you.

If there is a problem with your order, you must notify us within two working days of receiving the parcel. You need to keep all the original packaging since you may be asked to send us images of the goods that you have received.

9. CANCELLATIONS, RETURNS, AND REFUNDS

You have certain rights under the law:

You may receive a refund for an item if the product is unsatisfactory due to faulty packaging or if the product is defective within 30 days of purchase. Please note that we cannot accept returns on simply unwanted goods due to the nature of the products that we sell. If shipped back to us within 30 days, you will receive a full refund in the form the payment was originally received.  It is your responsibility to ship the product within 30 days to J.Nicole Skincare 1915 Ocean Way #231 Santa Monica, CA 90405 

If you cancel your order before the product has shipped, then you will receive a full refund.

J.Nicole Skincare ® is not responsible for adverse effects by products sold through the Website. It is your responsibility to choose the correct products for your skin type. We cannot be held responsible and provide refunds/exchanges on stock affected by damage or neglect after goods are received.

To return a product, you must email a returns request via e-mail to nicole@jnicoleskincare.com within the 30 days of you receiving your products with the reasons for the refund request. You will receive a reply which contains instructions for returns, a returns authorization number and the address where you must send your item to.  You will be responsible for the cost of returning the product to us unless it is faulty, incorrect or misdescribed.

The term "full refund" does not include delivery costs. You must return the product in suitable packaging to ensure that it reaches us in good condition. J.Nicole Skincare ® is not responsible for the loss of returned items during delivery. It is your responsibility to return the items via a secure delivery service.

If there is a problem with your order, you must notify us within two working days of receiving the parcel. You need to keep all the original packaging since you may be asked to send us images of the goods that you have received.

10. PRICE AND PAYMENT

Payment can be made by any major credit or debit card or via your PayPal or Amazon Pay account. Payment will be debited and cleared from your account before the dispatch of your good or provision of the service to you.

You confirm that the credit, debit card Amazon Pay or PayPal account that is being used is yours. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us we will not be liable to you for any delay or non-delivery.

 Please familiarize yourself with these terms and conditions before you place an order as we reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged.

11. DISPATCH AND DELIVERY

Orders are processed within 1 to 5 working days. Deliveries are made via UPS, USPS or Amazon shipping. If you do not want deliveries to be made by those options, you may request a change of service. Extra fees may apply to change the delivery service. You must e-mail  nicole@jnicoleskincare.com to request a change in delivery service.

You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the delivery address which you specified. Upon failure of delivery, there is a charge of $10 which will be taken out of your refund once the products are returned to us.
